Can you please confirm, you are going to; Start; Control Panel; Add/Remove Programs; Windows Setup; and under System Tools, when you tick the Backup box and select OK, you are getting the above message.
to run a system file check. It's just possible, you have a corrupted file that is causing the problem. You may need your Win98 CD handy, in case the utility asks for it.
Even though it's a fresh install, the fastest way may be to re-install again "over the top", which will ensure any personal data remains intact, (providing you don't format the drive) but this time select "Custom Installation" and make sure the Backup utility is included.
