xbox 360 elite faulty

bought my son xbox 360 elite the warranty ran out in july 12th 2010.
it asked him to update console since then it reads the disc then says open tray.
ive had a look on line and its a common fault thousands of people are having the same problem.
it seems its all to do with a microsoft update.
ive rung microsoft and asked if there prepared to mend it.
the answer is no i will have to pay £90 + vat
i explained its a common fault and that a consloe shouldnt be breaking down at 16 months old.
i wasnt nasty or rude he was sympathetic but he stated microsoft couldnt go repairing consoles out of warranty.
i explained that i didnt think a 16 month old console was a reasonable time for something to break down.
any ideas on were i should go now.#

The Open Tray error is widely reported online and MS have consistently stated they will not extend any warranty to cover this issue.

The reason it has happened to you after an update is that the new update from Microsoft prevents the Xbox from reading games if it's running too hot.
