Apple Ipod Touch 2G OS3

Apple are releasing OS3 this summer, free for iphone but $9.95 for the touch.
My Ipod Touch cost £345.00 at Christmass (32GB 2G), as it still under warrenty does this breach UK Consumer Rights?
It is under 3 months old and yet Im paying for an update already.

Also, to develop applications for the OS3 SDK the license fee is $99.98, but do you need a license to develop hardware for Apple? Especially as I intend it too be developed with cross platform support?
