Following largely successful legal attacks in Europe Apple has moved its fight against Android, and in particular Android device maker Samsung, to the US.
Apple has won a key scheduling victory in the Northern District of California. But the trail doesn’t begin for nearly another year – indeed over 15 months after the original complaint..
The iPhone and iPad maker has won its first federal lawsuit against Samsung, with ‘Apple vs Samsung’ going to trial July, 30, 2012.
Apple had requested a February 2012 trial date, with Samsung countering that the average time for patent cases to get to court should mean it delayed until March 2013.
Patent specialist Florian Mueller considers this a “major win” for Apple considering the complexity of the case.
Earlier this week in the Netherlands Apple was granted a preliminary injunction banning Samsung from selling its Galaxy smartphones in Europe. The embargo concerns Samsung's Galaxy S, Galaxy S II and Ace smartphones.
A day later a German court upheld a preliminary injunction requested by Apple, preventing Samsung Electronics from selling its Galaxy Tab 10.1 tablet in Germany.
And Apple has been accused of manipulating evidence to make the Samsung Galaxy devices appear more like their iPhone and iPad rivals.
